A lawsuit has been filed alleging that a hotel in North Myrtle Beach did not alert guests to a gas leak, resulting in a man becoming ill.
The legal complaint, submitted last week in Horry County, states that the plaintiff, William J. McCarthy, was staying at the Avista Resort in North Myrtle Beach in June 2021 when he was exposed to carbon monoxide. According to the suit, McCarthy experienced symptoms including headaches, dizziness, and nausea, which he claims were caused by the gas leak.
The lawsuit asserts that the hotel failed to notify guests of the presence of carbon monoxide and did not evacuate the premises after the leak was detected. The complaint further alleges that the hotel did not have adequate safety measures in place, such as functioning carbon monoxide detectors, and did not conduct regular inspections to prevent such incidents.
McCarthy is seeking damages for medical expenses, lost wages, and pain and suffering. The lawsuit names the Avista Resort and its parent company as defendants.
Representatives for the Avista Resort did not immediately respond to requests for comment regarding the allegations.
